TERMS AND CONDITIONS : The making of a bid at the auction constitutes acceptance of all of the terms and conditions herein set forth. All active bidder's (buyer's) must read and acknowledge the auction terms and conditions of the sale printed on the buyers registration card and buyer catalog if provided, also any verbal changes in terms and conditions as announced at and during the course of the auction sale. By signing the registration card buyers, and buyers agents, acknowledge and accept said terms and conditions in part and in whole and hereby agree to indemnify, defend and hold harmless Seller and Columbia River Auction, LLC from and against any and all liabilities, costs, damages, losses, and attorneys' fees arising from or in any way related to buyer or buyers agents, movers, dismantles, riggers, electricians who may be performing work at the auction site for buyer. Buyer also agree to indemnify, defend and hold harmless seller and Columbia River Auction from any future claim which shall pertain to fitness or use of any assets purchased by buyer or buyers agent at the auction sale
ALL ITEMS SOLD : will be offered in units of piece, pound, foot or by the lot to the highest bidder. All items will be available for inspection before the sale, during which time prospective buyers or buyers agents will have the opportunity to examine the property to be sold. Although samples of property sold in groups or lots are believed to be representative of such groups or lot's, prospective buyer or buyers agents are requested to inspect the property prior to the auction sale. Failure to inspect any property will not constitute any grounds for any claim, adjustment or rescission by any buyer or buyers agent. While quantities, descriptions and capacities are believed to be correct, there are no guarantees, the Seller, Columbia River Auction, LLC or advertising counsel will not be held responsible for any written or verbal discrepancies or inaccuracies whatsoever. All announcements about the conduct of the auction, terms and conditions of sale governing the auction, made by Columbia River Auction, LLC or its' representatives, at the time of auction, take precedence over any prior printed materials about the auction.
All SALES ARE FINAL : and all items are sold, AS IS, WHERE IS, without warranty by seller or Columbia River Auction, LLC . Seller and Columbia River Auction, LLC disclaim all warranties, expressed or implied, about the merchantability of the items sold and their fitness for a particular purpose, use, quality, size, character, weight condition or kin, or that such property condition is fit to be used for the purpose for which it was originally intended. Descriptions in the ads, announcements and brochure are not deemed to be warranties. Seller, Columbia River Auction, LLC, auctioneers nor any representative is authorized to make any other representation or warranty about the property, except guarantee to good title of all items sold. Buyer agrees to pay all costs of removal and hereby accepts all liability for any and all damage claims for injuries to persons or property caused by removal of items purchased. Columbia River auction, LLC shall not be liable for any injuries or property damage resulting from any defective condition of the auction premises, latent and otherwise. All persons attending the auction safe assume all risks of coming on the premises, including risks of latent defects and hazards.
PAYMENT MAY BE MADE : by cash, certified or cashiers check, wire transfer or company and personal check when accompanied by a bank letter, from purchaser's bank guaranteeing full payment of purchases. Full payment of balances owed shall be paid with 48 hours after conclusion of the auction sale, All methods of payment should be made payable to Columbia River Auction, LLC in the event the buyer fails to pay the purchase price within the time limits set forth and/or fails to comply with any of the terms of the sale, then Columbia River Auction, LLC may resell at public or private sale any and all of the buyers merchandise located at the seller site and buyer hereby agrees to pay any deficiency resulting from such resale together with all charges, fees and expenses as a deposit toward the purchase of the merchandise may be retained and applied to any such deficiency. BUYERS PREMIUM OF 10% will be charged on the total of all purchases and added to all invoice totals. Buyers Premium will be paid the day of sale, NO EXCEPTIONS. Columbia River Auction, LLC assumes no liability for any errors of omissions in brochures, catalogs, or printed material
REMOVAL : No purchase may be removed from the premises until the conclusion of the auction sale and payment in full has been received. Purchases must be removed within the time limit as announced by a Columbia River Auction, LLC representative at the start of the auction sale, unless other arrangements are made and agreed to in writing by seller or Columbia River Auction, LLC if, for any reason, the buyer fails to remove any items purchased within the specified time limit, because of his own negligence or inability to perform, then Columbia River Auction, LLC shall have the option of arranging for the removal of the property and storage in a public ware house with a 30-day limitation for its safe-keeping . Columbia River Auction, LLC shall be reimbursed for all costs incurred for removal and storage, or may choose to leave the property on the premises and may deem it abandoned, ownership shall then revert back to seller at which time seller may dispose of the property as they see fit.
WHEN EVER THE AUCTIONEER SAYS SOLD : The buyer assumes ownership and responsibility for any and all property purchased at the auction sale. Buyer is responsible for dismantling , care, handling, removal and all risks of loss or damage to to the property, and shall have all obligations and liabilities associated with owner ship of the property. The seller nor Columbia River Auction, LLC assumes no responsibility for any liability once title passes ,
HAZARDOUS CHEMICALS, WASTES AND OTHER HAZARDOUS CONDITIONS : Buyers acknowledges that they have been warned by the Seller and Columbia River Auction, LLC that the surplus items being sold may include articles which can be hazardous in operation which may contain hazardous materials which may be or may become by chemical reaction hazardous to life, health or to property during use, handling, cleaning, reconditioning, disposal, removal or at any other time. Buyer hereby discharges Seller and Columbia River Auction, LLC from any and all liability directly or indirectly resulting from the presence of said chemicals and/or conditions resulting from the failure of the Seller and/Columbia River Auction to give a more specific warning or from the inadequacy of any warning. It is agreed that Buyer shall be considered the generator of any waste resulting from the removal, transportation, installation, possession or use of the surplus items purchased.
